WMC Resources has been prosecuted for failing to provide and maintain a safe working environment at its Mt Keith operation in the northern Goldfields south of Wiluna.
The prosecution arose from the Department of Industry and Resources’ investigation into the death of Daniel Comrie on September 13 2002.
Mr Comrie died after the haulpack truck he was driving fell 60 metres into the sump of the Mt Kieth open cut mine.
WMC pleaded guilty to contravening Section 9 (1) and (7) of the Mines Safety Inspection Act 1994 for failing to comply with its general duty of care as an employer to provide and maintain a safe working environment and was fined $40,000 plus costs.
